Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Fluxopus platform ("Service") operated by Fluxopus ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Service Description
Fluxopus is a workflow-assessment and automation-tracking platform that helps companies:
- Complete questionnaires to identify automation opportunities
- Track tasks with time-before and time-after measurements
- Generate AI-powered analysis and automation recommendations
- Connect to third-party tools via OAuth integrations
- Measure and report time savings
3. Account Terms
- You must provide accurate and complete information when creating your account.
- You are responsible for maintaining the security of your account credentials.
- One person may not maintain more than one account.
- You must be at least 16 years old to use the Service.
- You are responsible for all activity that occurs under your account.
4. Subscriptions & Billing
- Fluxopus offers a free tier and paid plans priced per company.
- Paid subscriptions are billed in advance on a monthly or annual basis.
- All fees are exclusive of VAT unless stated otherwise.
- We may change pricing with at least 30 days' advance notice. Price changes take effect at the start of the next billing cycle.
- If payment fails, we may suspend access after reasonable notice.
5. Right of Withdrawal
If you are a consumer in the European Union, you have the right to withdraw from a paid subscription within 14 days of purchase without giving a reason (EU Directive 2011/83/EU). To exercise this right, contact us at support@fluxopus.eu with a clear statement of your decision. We will reimburse all payments within 14 days of receiving your withdrawal notice.
If you have actively used the Service during the withdrawal period, we may deduct a proportionate amount for the service already provided.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to violate any laws
- Attempt to gain unauthorised access to the Service or its systems
- Interfere with or disrupt the Service's infrastructure
- Reverse-engineer, decompile or disassemble any part of the Service
- Use the Service to send spam, malware, or other harmful content
- Resell, sublicence or redistribute the Service without our written consent
7. Intellectual Property
Our platform: Fluxopus and its original content, features and functionality are owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.
Your data: You retain all rights to the data you create, upload or input into the Service. We claim no ownership over your content.
8. User Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use and protect your personal data. You can export your data at any time using the CSV export features built into the Service.
9. AI Features
- AI-generated outputs (automation recommendations, task analysis, workflow blueprints) are provided as suggestions only and should not be relied upon as professional advice.
- We do not guarantee the accuracy, completeness, or suitability of AI outputs.
- You are responsible for reviewing and validating AI recommendations before acting on them.
- Text submitted to AI features may be processed by third-party AI providers as described in our Privacy Policy.
10. Third-Party Integrations
The Service allows you to connect third-party tools via OAuth. When you enable an integration:
- You authorise us to exchange and store tokens on your behalf (encrypted at rest).
- We are not responsible for the availability, accuracy, or practices of third-party services.
- You can disconnect any integration at any time.
11. Availability
We strive to maintain high availability but provide the Service on a "best effort" basis. We do not guarantee any specific uptime percentage. We may suspend the Service temporarily for maintenance, updates, or circumstances beyond our control.
12. Limitation of Liability
- To the maximum extent permitted by Dutch law, our total aggregate liability arising out of or in connection with these Terms is limited to the amount you have paid us in the 12 months preceding the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
- Nothing in these Terms excludes or limits our liability for gross negligence (grove schuld), willful misconduct (opzet), or any other liability that cannot be excluded or limited under Dutch law.
13. Termination
- You may cancel your account at any time from your profile.
- We may terminate or suspend your account for material breach of these Terms after providing reasonable notice (except in urgent cases of illegal activity).
- Upon termination, your data remains accessible for 30 days to allow export. After that, it will be permanently deleted.
14. Data Portability
In line with the EU Data Act and GDPR, we are committed to preventing vendor lock-in:
- You can export your data (tasks, time logs, analytics) in CSV format at any time.
- There are no technical barriers to switching away from Fluxopus.
- If you decide to leave, we will provide reasonable assistance in migrating your data.
15. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these Terms shall be submitted to the competent court in the Netherlands. If you are an EU consumer, you may also bring proceedings in the courts of your country of residence.
16. Changes to These Terms
We may modify these Terms from time to time. We will provide at least 30 days' notice of material changes by email or by posting a prominent notice in the Service. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you may terminate your account before they take effect.
